These Terms of Service ("Terms") govern your use of mindmade-media.com, our design, branding, and marketing services, and the AI Website Builder (together, the "Services"), provided by Mindmade Media ("Mindmade Media," "we," "us," or "our"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.

1. Who We Are

Mindmade Media is a web design, branding, and digital marketing agency based in Lancaster, California, serving clients throughout the Antelope Valley and beyond.

2. Our Services

We provide custom website design and development, brand identity design, digital marketing and SEO, UI/UX design, print and packaging, and photography/video services, along with an AI Website Builder that generates websites based on information you provide. Specific deliverables, timelines, and pricing for custom projects are set out in a separate quote, proposal, or invoice, which forms part of these Terms for that engagement.

3. Client Responsibilities

You're responsible for providing accurate information, timely feedback, and any content (text, images, logos) you supply for your project, and for confirming you have the rights to use that content. Delays in providing materials or approvals may delay project timelines.

4. AI Website Builder — Additional Terms

  • The AI Website Builder generates website content and design based on inputs you provide. Review generated content before publishing — we do not guarantee the accuracy, legality, or fitness of AI-generated text or images for your specific business or industry.
  • You may not use the AI Website Builder to generate content that is illegal, infringing, defamatory, fraudulent, or that impersonates another person or business.
  • We may remove or refuse to host generated sites that violate these Terms or contain malicious code.
  • Generated sites are served through our infrastructure at a Mindmade Media subdomain or a domain you connect; we are not responsible for third-party domain, DNS, or registrar issues outside our control.

5. SMS Terms

If you voluntarily opt in to text messaging (for example, by checking the SMS consent box on our contact form), the following terms apply:

  • You may receive text messages from Mindmade Media related to your inquiry, quotes, scheduling, project updates, customer support, and other service-related communication.
  • Message frequency varies.
  • Message and data rates may apply.
  • Reply STOP at any time to opt out of further text messages. Reply HELP for help.
  • Consent to receive SMS messages is not a condition of purchasing any service from Mindmade Media.

6. Intellectual Property

Upon completion of a custom project under your project agreement, you receive ownership of the final website design and content created specifically for you, excluding any third-party assets (stock photography, fonts, licensed plugins, or code libraries), which remain subject to their own licenses. Mindmade Media retains the right to display completed work in its portfolio, case studies, and marketing materials unless you request otherwise in writing. Our own tools, templates, code frameworks, and the AI Website Builder platform remain the property of Mindmade Media.

7. Acceptable Use

You agree not to: misuse the Services to distribute malware or spam; attempt to gain unauthorized access to our systems, admin tools, or other users' data; scrape or copy the site's content for competing commercial use; or use the Services for any unlawful purpose.

8. Disclaimers

The Services are provided "as is" and "as available." While we work carefully and professionally, we don't guarantee that the Services will be uninterrupted, error-free, or that a website (including AI-generated sites) will achieve specific search rankings, traffic, or business results.

9. Limitation of Liability

To the fullest extent permitted by law, Mindmade Media's total liability for any claim arising from the Services is limited to the amount you paid us for the specific service giving rise to the claim in the preceding 12 months. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data, arising from your use of the Services.

10. Termination

We may suspend or terminate access to the Services, including hosted AI Website Builder sites, for violations of these Terms or abuse of the platform. You may stop using the Services at any time.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Los Angeles County, California.

12. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page with an updated "Last updated" date. Continued use of the Services after changes means you accept the updated Terms.
